Here is the deal. I have an acquaintance that is divorcing his wife. He filed the papers, she went into default by not responding to the paperwork and everything was proceeding smoothly.

She got angry at him and decided to file a motion to dismiss the default. She also filed for cutody of their children (one currently lives with her and one with him). She also claims that he said they would get back together. I know that California is a no fault state and that shouldn't matter but what about all the other lies she'll make up. She says that her son has lived with her and he hasn't. Who knows what she'll come up with next.

I would like to know would the judge change living arrangements for the children if everything is fine how it is? They have been married for five years. Will she be awarded spousal support? She never really worked cause she was too lazy and she is too lazy now. She wants the kids for the money she would get for child support if she has both of them (she lives in a cheaper state and she can almost live off of the child support for two children..she would get a boyfriend to pay the rest.)

What would be your suggestions? What can he do? How can he protect himself? Getting a lawyer would be costly and then she might get one and ask the court to make him pay since she has no job.....

Any advice is appreciated.
