OP: there may be a slight chance that a Prosecutor will help by substituting a non-moving violation...
Ask the bailiff in that traffic court --- s/he knows everything anyone wants to know about tickets and, most imp, how to handle them & what works with that Judge/Commissioner.

If you approach the bailiff during a quiet time, you may get some useful advice.

In all the times I've read Carl's responses (and they are plentiful), I don't believe he's EVER been wrong.

Well, apparently there is a first time for everything. As I stated earlier, Carl is wrong about the OP's protection under the speed trap laws. First, I still haven't seen the OP state that he was in-fact driving a commercial vehicle and second, commercial vehicles are not exempt from protection of speed trap laws. On the other hand, Carl was correct about a class A license holder not being allowed traffic school in lieu of prosecution. I had heard of that new statute, but I hadn't seen it yet. However, I'm not sure if that applies to the non-commercial class A license.

Jim_Bo, you sound as though you're just typing in questions from a book on How To beat Your ticket.

I have several resources I use. The primary one is the California Vehicle Code.

No book can substitute for hands-on experience and intelligence - attributes Carl has, and you don't.

You don't know what I have type of hands-on experience I have, so to make a statement like that speak directly towards your intellegence. As a cop, I would concede that Carl has ample experience writting tickets, but not necessarily defending himself against tickets. I am not a lawyer. I have just been facinated by the fact that most speeding tickets that I have seen people recieve in CA could be easily defended against because the cops who wrote them did not have a good understanding of the law or simply didn't bother to take steps necessary to ensure their tickets were appropriate.

I think you have it backwards... Carl is the one who picked this fight. I was asking some very valid questions of the OP which were directly related to very valid defenses. I think that the OP could beat this ticket pretty easily if he was willing to put forth a bit of effort (and not insult those who try to help him.) I have beaten and help others beat at least a dozen tickets in the last couple years in CA with a 100% success rate. While I don't suggest that a dozen successes makes an impressive track record, I am suggesting that CA law is generous enough to motorists that even a guy who lacks credentials the way I do can easily defend himself successfully.

So, since you have the high position of making judgement on my intellegence, I am interested in some of your statements. You suggest that the OP try to convince the prosecutor to substitute a non-moving violation for a moving violation. I'm not sure what kind of non-moving violation he could substitute for a speeding ticket.... maybe he could substitute in a Jaywalking ticket for the moving violation? I'd like to know more about this strategy of defense. However, of all the times I have been to traffic court, there is almost never a prosecutor present, so I'm not sure who he would ask to do this. Prosecutors are not required to be present at traffic court. Maybe you could also shed some more light on the strategy of "asking the baliff". After all, as you state, the baliff knows EVERYTHING about traffic tickets. This is another brilliant strategy that I would love to know more about. Please do shed some light. Also, please discuss the strategy of getting the baliff to divulge "what works with the commisioner/judge". In all of my lack of experience, I have always relied on the law working with the commisioner/judge.

By the way I am a female " dickhead"- AS YOU WILL.... with a Commercial Class A drivers license!

I was driving a DODGE RAM 2500 4X4 long bed (not a dually) cuz I also have one of those), white with charcoal grey interior. I was pulling my horse trailer -gooseneck w/ 2 AXLES, empty, sited for going 65. YES IN CALIFORNIA , IF YOU ARE PULLING A "TRAILER" YOU ARE SUPPOSED TO GO 55.
I AM WELL AWARE OF THIS- BUT IN REALITY, I WAS GOING 75 ;) AND HE (NICE OFFICER) :) MENTIONED THAT. He also said the TRUCKERS were going about 61-65. He was kind!

I am not here to "get out" of paying the ticket, just lowering it and getting it off my record because I drive a transfer truck (w/a trailer and plenty of axles) its black by the way... and (of course) do not need it on my record. I havent gotten a ticket of any kind in over 7 years and thought possibly someone in CALIFORNIA would know the $$$.

1. I didn't call you a dickhead. I called Carl a dickhead because he was acting like one.
2. I don't think I ever made reference to your gender, but I did make reference to the fact that you were pretty damn rude to a person who only wanted to help you.
3. I am in California.
4. As Carl pointed out, you are not eligible for traffic school since you have a commercial class A license. So, the ONLY way of keeping the ticket off of your record is to "get out" of it.
5. As I stated before, if you really didn't want the help... you shouldn't have asked for it, and you shouldn't have been so rude to those who tried to provide it.
