Can a contracted employee get unemployment?

Hello all again,

This is for Saint Louis, Missouri.

Can a person that is contracted get unemployment benefits? Let me explain. I have a client that was working for a tech agency that was employing him for Boeing. So basically, Boeing was using the agency to find them employees to work for a set time. So Boeing was paying the tech agency a certain amount and they would pay their actual employee a percentage of that and keep thier profit. Say the contract was for a year, two years, or contract to hire over a few months. This contract was for a year. He along with three others were laid off due to lack of work. He has already filed for unemployment. Is he able to receive it? He has already recieved a letter from unemployment showing he has earned enough to recieve it.

Looking for solid answers please, not assumptions.

He's already received a financial determination. He was laid off. Why is there even a question?

He is able to collect based on his employment with Tech Agency. It has nothing to do with Boeing, and Boeing's unemployment premiums will not be affected.

There's your answer. But is it solid enough for you? I'm assuming not, since you went to the trouble of posting here.

Unfortunately, I don't know where you could possibly get an answer that's more solid than the one unemployment's already provided.

No one here is in a position to give a binding answer. The UI office, and only the UI office, can give the "solid answer" that you are looking for. No one here can give you anything more than a guess.

"contractor" has no legal meaning. If he was an employee (taxes withheld), then he is eligible IF he has the requisite earnings and IF the reason for separation from employment is not a disqualifying one.

If he was an independent contractor (no taxes withheld), then he is not eligible for UI.
