What is the name of your state? NC Just my opinion, but it seems that when one spouse goes out and commits adultery, has unprotected sex, then goes home and has unprotected sex with his/her mate that that is reckless endangerment or gross negligence. He/ she is exposing themselve to all kinds of diseases and then taking it back to an unknowing person. Has there ever been a case where someone has been charged for this?

Further more-

What? I don't understand the hostile reply.

1. I'm not doing homework and don't understand that remark at all.
2. I think that having to be concerned about your health for at least ten years after finding out your husband has been sleeping with the biggest slut in town is a legitimate concern.
3. My question was about the legalities - have there been any cases like that? Have there ever been civil suits?

I'm sorry that you think this is petty. I'll bet somewhere, though, there is an attorney who doesn't.

I never said it was petty. But, if you expect us to do your research for you, then you'll have to wait a very long time. This forum is for specific legal questions regarding issues you ARE dealing with, not what might happen.

IF and when you contract a disease or are dead, or when you have a specific legal question, then please return.

I'm not doing research or asking a hypothetical question. I am in this situation and I was asking for legal advice. I am not a law student - I draw houses for pete's sake. That's ok, though, I'll ask my question elsewhere. You can keep your finger and I'm sure you know where to put it.

If he didn't actually give you a disease..then you have nothing upon which to base a case.
