My divorce was final this January, but my ex spouse believes she is entitled to alimony, since she was not working at the time of the divorce and has some personal ailments. We were married for approx 3 years. She worked the entire time we were married, except when she quit her job about 5 months before the divorce was final. It was a no fault divorce in the state of Tennessee.

I agreed to pay 36 months of COBRA payments and medical copays until she finds another job.

Could she file a petition to have the divorce ammended and have alimony added in addition to the COBRA payments and copays, even though it wasn't previously established?

Please help. Thanks.

My response:

Simple answer - No.

Unless Spousal Support was made a part of your Marital Settlement Agreement, or unless it was a part of the Decree, then the court is without jurisdiction to add or subtract any requirements, like Spousal Support, to your obligations.
