Can an employer take back a paycheck???

What is the name of your state? Pennsylvania

I worked full-time for the local Kmart until the store closed. Yesterday I got a paycheck for $300 that I wasn't expecting. Obviously ( :D ) I didn't think twice about cashing it and putting it into the bank. I've also spent $25 of the money. Now they call me and say that the Human Resources people screwed up and that I will be receiving a letter informing me of how I can send Kmart the money back. Can they legally request this money even though it was their payroll people who made the mistake?

It never ceases to amaze me how many people seem to think that the law is going to allow them to keep money they are not entitled to, as long as it was the other party's mistake. Yes, you have to return the money. Don't be absurd.

If you overpaid a bill by $300, you would ask, no demand, that the money be returned to you immediately. Guess what, the laws apply in both directions.
