can an ex get out of a judgement?

I was granted a divorce by default and was granted judgements for $1,400 for part of the legal expenses and $6,000 for past due child support.

My ex never showed up for any court appearances & did not have a lawyer. My divorce was final in February 2002.

There was never a dollar amount put on those judgements so i'm not getting anything. He's currently unemployed so I didn't rush to figure this out sooner - but his unemployement is almost up and he will be getting a job soon.

My question is this - I'm going to motion these judgements up in court when he gets a job. Is there a chance that my ex could show up and get out of paying them? He currently doesnt' even know about them because he's never gone to get himself a copy of our divorce decree. He'll go crazy when he finds out - that's why I haven't told him. I have a whole binder of anything/everything, receipts of all kinds, and anything else I could get my hands on about every penny spent on our baby. I had to prove the dollar amount in court the first time - but I know if/when my ex finds out he will surely disagree because when he left me (when our baby was 5 weeks old) there was $4,000 in a bank account and I took it out so he couldn't take it for alcohol/drugs. Anyhow - my ex ASSUMES that the $4,000 was advance child support. Although that $4,000 was saved from MY income too while I was pregnant.

Is it possible he could get out of having to pay this back to me?

My response:

As far as the "legal expenses" are concerned, yes. It's called Bankruptcy.

However, as far as the child support and arrearages are concerned, those debts will follow him beyond his grave.

Go slap an Order to Show Cause Re: Contempt of Court on him. And, tell him to bring his toothbrush, a change of underwear, and some Petroleum Jelly.

Thanks for the advice. I AM going to do something although I'm a little nervous to do anything without a lawyer.

Was I suppose to tell this guy about those judgements? i've never mentioned it to him. Honestly because I'm afraid of the day he finds out (and he hasn't had a job yet anyway). To an unemployed LOSER $6,000 might as well be a million. He'll freak out.

He's never seen a copy of the divorce decree and I'm worried that somehow it will seem as though I've deceived him or tried pulling "one over on him".

Do you think something like this is 'safe' to handle without a lawyer? I DO have a whole binder filled with anything/everything about this man. Spreadsheets w/receipts to back it up, police reports, bills I've sent to him re:medical reimbursement...I mean a whole binder tracking every piece of paper and detail that's happened since he walked out!
