We are looking for any informative resources or motion(s) that can help exonerate our brother. David Chebatoris (the public defender) is using a strategy that attacks the alleged victim, ignoring obvious witnesses, and next to no/poor communication. What options do/does We/he have in this case?

Our brother was set up to take the fall for the alleged victim's biological father's abuse. Our brother and his girlfriend had shared a house with the victim's father, who was convicted of abusing his child (victim) 4 mos prior to the arrest of my brother. The victim is being coerced by both her foster parents/particularly the aunt (sister of the father) and the investigator (anything for a conviction, anybody seen episode on Montel?).

All statements from the case are extremely suspicious and inconsistent. The hospital's evaluation of the alleged victim was deemed inconclusive. Which there is no physical evidence of sexual abuse? Is the victim's father on the witness list, you ask? No!!

We would love to pay some expensive, big time lawyer a lot of money, so he can help my brother....try again!!, there's no guarantee that it wouldn't be deja vu all over again. There is a travel issue and most difficult to communicate with my brother's wife. Good AdDVICE or resources is greatly needed........ please!

He NEEDS an attorney. Period.

However, there are some things that don't make sense. Your brother lived with his g/f, who is now in foster care - so she's underage? How old is he? And what is this about his wife?

I apologize if I have confused everyone. the alleged victim in the spring of 04 was 9yrs old. My brother and his 42 girlfriend used to live with the victim.

The foster mother is also the aunt of the victim. She seems to be "running the show". After receiving the depo's, it has become very obvious that this little girl is well rehearsed and answers based off of certain words that are asked in the questions.

The public defender wants to go with a Fantasized Strategy. Would it be a good idea to have my brother give a power of attorney to myself in order to protect his civil rights.

The PD made it very clear to me that all of my concerns and questions did not have any bearing on this case. When I inquired if he knew what a tainted case, he responeded he didn't know what that was. I also asked how much experience he had in child molestation, he got aggitated and said he didn't have to tell me.

The list goes on, and on, he shot down all my questions, and to top it off, he complained and stated that he had to pay for all 8 depositions out of his own pocket. $900. He went as far as telling me he really didn't want to speak with me because he would have to bill the state for the time????

Help!!!!!!!!!!!!!!!!!

Actually, your brother's attorney doesn't have to talk to you AT ALL, let alone explain to you the defense.

Mr Stealth2, thanks for stating what is the obvious. We would appreciate your advice or any options, not the current obstacles.
Reading some of your other COMMENTS to members, they seems to be plague with opinions and criticism. Thanks, but NO Thanks!!! We are open to any possible solutions, The reason most people visit web sites like this one is to discover information that they were unaware of or not thought about. Ideally, we would all love to have the attorney that aggressively represents the client, but we live in a time where money is the objective, not the long arduous case. Even the cost of asking a simple question to an attorney could be very expensive and only based on their individual experience. We are seeking advice and would appreciate a valued response.
