Can CS be pro-rated upon termination?

What is the name of your state (only U.S. law)? Maryland My current support order states child support to end when child becomes 18. Child would have graduated high school by this time. CS is paid directly to mother from myself. Order "only" states CS to be paid monthly in sum of -----.

My question is would I be legally allowed to pro-rate CS from the first day of the month till the child turns 18? I'm sure I'll get response's of those who disagree with my question; that's fine, I've thought it through and don't care how it sounds. This is for my personal preferance of satisfaction for the ---- I've been through. I'll be honest! ;) So a legal answer is the only thing I care about.

okay....is child support due on the first of the month in x amount of dollars?

It is stated as "the sum of ---- will be paid monthly" no other reference to when or how is made. That is why I ask; I have always just sent a check by mail the first business day or two of each month directly to her. Never really occured to me that a numerical date or a pay-by date wasn't included.

then pay the first of the month the month your child turns 18. and no you cannot prorate unless the court order specifies such.


since child support is paid on a monthly basis, you owe for the entire month. if child support was calculated on a daily basis, then you might have an arguement. but i gather from your post, you want to be done with it. so write the check, and move on.

I fiqured I would do just that anyhow; better to just be done with it. After all these years I probably still wouldn't get the satisfaction I would like.

is your child healthy? alive? loved? properly cared for? you should have that satisfaction. trying to stick it to mom for having to be a responsible parent one last time isn't worth it. when you write that last check, and mail it off, and with it, mentally send your resentment off with it.

So your just trying to get the last laugh at the end of the road for being legally obligated to financially care for your child?

Here is your legal answer: There is no statute in MD that allows YOU to decide to pro-rate your child's child support. Judges can deviate from the guidelines for whatever reason, but its really not worth it to go back to court to ask for such a stupid request. You are to pay the full amount monthly on the day it is due (1st) until your child turns 18.

Except for the part about there being a "due" date of the 1st(there's no set date that I am aware of), I'll agree with this.

You have a point there. Based on what OP says, his order doesnt mention a due date. Mine does, so i shouldnt have got that twisted.....thanks

Well...there goes your request of simply asking in a LEGAL manner.
Some people just need to stop trying to heros. LOL

If you want satisfaction think of it this way instead...from that point on you are going to have far more disposable income available to you, and the other parent is going to have a serious drop in disposable income. That should give you a lot more satisfaction than pro-rating the last month.

If I pro-rated, she would get only eight days. It's not about the money. It's about me being simple just to tick her off because there was nothing she could do about it..

My intentions lay with doing something because "I can" and it not affecting my child for once. Even though I have a legal custody(blah blah blah) the truth of the matter is things went the way she wanted, because in the end it would have caused problems between my daughter and I since my ex does things "just because she can" and if I disagree' the better she felt about it. Let's face it legal custody allows in reality, nothing more then access to information unless you can prove harm is being done to the child. And she-bitc** becomes she-princess when it's in front of others.

So, yes for once, I wanted to give her a piece of her own medicine, "just because I could" and it would not affect my daughter and I; as to how she responded.

Actually after posting and getting this of my chest, whether I legally could or not; I don't feel like hearing her b***** about that either. Rather just pay her off so I can laugh about never being obligated to commincate with her ever again. I'd pay twice as much for that but I'm sure I couldn't be that lucky.
