Someone complained about a smell of marijuana in the locker room..they determined the smell was coming from my jacket and searched it to find a small amount of cannabis. This search was done without my knowledge while i was away working. I am now suspended pending an investigation in which i assume ill be terminated. Is there anyway i can keep my job

Mike In the job place the only times a employee is entitled to privacy is while toileting or reasonable privacy say like when one must change clothes like say gender specific locker rooms. If you used things at work that belong to the employer like say a desk at work the employer can search it, If you use a computer at work the employer can spy on your use, phone calls that are personal , well the best thing to do is to call the person back while your on a break and away from normal work station. As to your clothing smelling like pot , well _____________________________________

This is not true.

And the state matters.

The legality of a workplace search depends on many factors and generally must be determined on a case-by-case basis.
