can he get supervised visitation?

My ex and I have been battling over my daughter whom is 15, because she no longer wants to live with him. Last month she reported to the school he choked her, it was reported to cps and the sheriff whom took a report and filed with the municiple court, as of right now nothing has been done. But tonight my daughter told me her father and sm was trying to make me have supervised visitation and said she is doing drugs, having sex, and drinking when she is with me, just another way to keep me from her, This of course all a lie and I will take a drug screen or whatever else to prove it, My daughter is literally sick living with her father they treat her like a prisoner and constantly threaten and berate her. Can they just get supervised visitation like that, I tried to get her into foster care or with me when she reported the choking but because he has custody and we are fighting over her they wouldn't remove her from his home. I do have his niece on tape saying he admitted to his mother her grandmother he did choke her but I just got that and this is a one party state. Can someome advise, I want to move on this Monday. Thank You
 


No, I don't think that he could find cause in order to be granted the supervised vistation for you.

I looked over your other post and it does seem that he is in violation of the original order by refusing your parent time. The Judge comes down hard on these allegations. The penalties are harsh. Jail time can even be ordered for violating a court order. Be sure to document every incident.

Please take my advice right here. Please try your best to be civilized with your ex. If he can prove that you are irrational the Judge will side on his favor.

Go to counsiling. Reach out for assistance. This can be the toughest experience to go through and you need to be able to set a good example to your daughter.

How to communicate your feelings effectively. So far screaming and yelling, the threat of violence does not and will not accomplish anything.

Thank you so much, just the thought of my ex keeping me from my baby was breaking both our hearts, I haven't been able to think of anything else. My ex and his wife are trying anything right now to make me look like I'm a bad parent and I am not, I've been trying for years to get along with my ex and have really given into a lot of his demands for the sake of my daughter and I think because I have been standing up to him more and demanding that he respect my rights on visitation etc. he feels like he is going to force me to give up the fight. Its not going to happen because my daughter is so unhappy its so sad to talk to her and see her. He has violated my rights to visitation, and driving one way or another for so many years and I went along and just did what I had to to be with my daughter and I will explain all that when the time comes, my ex thinks because he has more money and is remarried that he is better than me and above the law. Plus he abused me and I used to be afraid of him but I am not anymore. Believe me I know when to keep my mouth shut in court and I think If I just am honest I will get custody of my daughter because I am the parent that will compromise for her sake and regardless what I think of her father I would never keep her from him if thats what she wanted.
