i know that i just said that plan A was back on but he got more hope from josiesmom's thread.
there is no custody agreement and the baby has been in texas for two weeks. if the father finds them can he take the baby back to Cali? if he files for custody here then the jurisdiction is through CA how many times will she have to miss the court dates to be in default? once again, if not found how will we serve her the paperwork? i know that he keeps going back and forth on this but he really does not want to leave the baby behind. the mother is a young girl that likes to party with drugs and alcohol. the baby will be warmly welcomed.

Why in the hell don't you and your husband leave the mother and the child alone. By your facts: The mother is barely 18 and the child is almost one. That means that the mother gave birth to the baby when she was barely 17 and your husband screwed her while she was a child of 16 and he was a married man with a child at home. The law would indeed have to be an ass to give him custody of this child and there is nothing stable about a arriage wherein the husband is off screwing a teenagers when he has a wife and toddler at home.
