Can i Adopt

I was with this girl for a year when she had a baby by someone else. we decided to stay together and try to work it out. In that time I grew close to her son and he started calling me dad. His biological dad was not around at all and eventually gave up his rights. We ended up breaking it off some time after that. We are still good friends and im still a acting parent in her sons life. He calls me dad and she acknowledges me as his father. We recently agreed to have him come live with me seeing as she has 2 other children, and is single. Will i be able to adopt him without any issues since i have his mothers permission,and since the biological father gave up his rights?

Was the father's parental rights terminated by a court? Or was he not granted visitation rights?

Are you saying that his mother is willing to give up her parental rights? That she is willing to no longer be his mother? If that is not what you are saying, then no, you won't be able to adopt at all.
