Can I aport my neice? She is in CPS care/foster home

I am in Arizona. I called CPS on my brother and his girlfriend for neglect of my almost 1 year old neice.

Mom voluntarily signed over her parental rights for 90 days. I had my neice when they 1st took her but she's now been placed with a foster family since parental rights were signed over.

CPS said if they do not comply ONE time they will close the case and go to court to adopt her out.

My brother is NOT willing to comply with CPS for fear he will go to jail. I doubt they will be getting thier daughter back.

Also, mom is telling CPS my brother is NOT the father and he is unwilling to do a paternity test. They think he will then not be forced to comply.

Should it come to the point where CPS says they are not giving her back I obviously want to adopt her.

My question, if CPS can't PROVE my brother is the father, will I still get the option to adopt since they can't PROVE I'm family?

Also, I have 4 kids, however, I have a very big home with 2 bedrooms not being used so I have room for her and am financially stable. Can they say I already have too many kids to take another?

Please help, I'm scared to death they will adopt her out to complete strangers and I'll never see her again

No you will not get a chance to adopt her -- in order to adopt you would have to be certified as a foster to adopt family in AZ. Since your brother is NOT the father legally apparently, you are NO ONE legally to this child.

Sorry for your pain. So am I to understand that the state now has custody o your grandchild? Was your son married to the mother? If so - he is the legal father (regardless of paternity).

it is a shame, but Ohiogal is correct - you have to be registered in the foster system..however, it would not hurt you to contact an attorney that specializes in thsi type of adoption.

By the way - then term is "placed for adoption" not "adopt her out"...
