Can I get a GC if my employer does not sponsor me?

I married an H1-B Visa holder & we had a daughter. He had been very abusive physically, mentally & emotionally. We are now divorced and I have an H-1 thru my employer. He has refused to sposor my Green Card as he says it is only for "key employees".

My ex has applied & received his own GC after the Divorce. Now, I only have 3 years left to get my GC approved, in EB3 category. If I go back to my home country, for a year or more as per INS rules, I will lose custody of our daughter (The Family Law Court's Counsellor had indicated that to me personally, though no order had been passed). It is virtually impossible for me to enforce Visitation also from there. In effect, I will lost all contact with her.

Is there any way I can apply for GC for myself? Will this be counted as extreme "hardship"?

Any advice would be appreciated.
