Can I get an absent father's name removed from a birth certificate?

My son's biological father has had no contact with him since he was less than three months old which was over a year ago. I am my child's sole provider for all needs, including financial. We were never married and I now live in another state. I have tried to contact him to see if he would voluntarily be removed and relinquish any parental rights, but I cannot track him down. He is a drug addict, has been in and out of jail, and is currently a fugitive, actively avoiding law enforcement.

Why do you feel the need to do this? What is your goal?

1. There’s absolutely no reason for him to be on the birth certificate considering he is not a father in the slightest bit
2. I need his approval for certain things (like getting a passport) solely because he is on the birth certificate

How old is the child? Where do you want to bring the child (what country)?

Also...Is there any court orders? Custody or Support? If so...What state is it in?
I’m planning on going ti Australia next January for a month and obviously would be taking him with me. There has never been and court involvement because like I said, there has been absolutely no contact in well over a year. He’s just gone and I can’t track him down.

I suggest you consult with a Family Law Attorney in VA to determine what to do.

Legally and until a court terminates his parental rights, he IS the father.
