NJ My ex is in arrears of over 80 grand. His mother lives in NY. She is elderly. If she dies and leaves money in her will in my ex's name, can I collect it for child support? What would I have to do to intercept the money?

Can you explain to me why you allowed the arrearage to get to more than $80,000.00? Why haven't you taken action sooner?

Yes, but its the CSE that would need to do the attaching...or you would need an attorney.

She really needs to get an attorney. This guy obviously has money and its likely that a judge would order him to pay her attorney fees.

As soon as the old gal buys the farm, find out where her will is being probated and file a claim against the inheritance in the probate court where her will is being probated.

Will it work?

I don't know.

But the lawyer you hire to collect this may have other suggestions also.

And hope the old bag doesn't live long enough to use up her money, that she doesn't leave a chunk of whatever is left to charity, or directly to all her grandkids, or to a trust. Or that she doesn't have medical and nursing home bills plus burial expenses that equal the estate value. If his dad is still alive, everything could go to dad. if there is anything. In other words, don't start counting on Grandma to payoff the arrearage. If you are liucky and there is an estate of some value, and if she leaves a chunk to sonny boy, and if she hasn't racked up medical and nursing expenses, it may work out.

It could be worth a try but chances are that it will not all go to your ex. You say he is working under the table. If so why are his CS payments so high?
