What is the name of your state (only U.S. law)? California

I have an idea to for a novel and entirely non-obvious use for an old technological device that has been around for many decades. It is in the medical field. Does scope exist, such that I can patent or obtain some form of intellectual property projection on this idea? What is the name of your state (only U.S. law)?

You might be able to patent a method for using the device, but you would not be able to obtain a patent on the device itself, since you didn't invent it. Talk to a patent agent or attorney who can advise you on whether or not the method of using the device is patentable.
