What is the name of your state? NJ I wanted to do a video and post it on the internet of sports compact racing events. The only problem is that ESPN shows one of the events on TV. Can I post the video of the event on the internet for others to watch?

The video would bascially cover what happened at the events.

What about the venue?

If you are the person who shot the video, then ESPN has no say in the matter, since their rights to the broadcast cover the version that they tape with their cameras.

BUT, you have to look at the rules of the venue where the event took place. If they forbid taping, then you may be out of luck. By agreeing to enter their location using their tickets you may have given up the right to record or broadcast any of the event.

Of course, depending on physical layout, you could use a telephoto lens from off site and catch some of the action. However, if you record any sound from the event and it includes the sound of the announcers over the PA system, you could be infringing their copyrights (and those rights may belong to ESPN, depending on who is doing the announcing).

We will be the one shooting the video. We are just going to be covering the same event except I will be showing the video on the internet, not TV.

The main reason why I ask this is because we will have it on the internet for everyone to see and we will have it up before ESPN does. I'm figuring this may take away from their viewers and they may throw some kind of lawsuit at us.

Events who sign broadcast contracts sign over 'exclusive broadcast rights' to the receiving party. Therefore, any broadcast of the event not originating from the assignment is illegal and will result in two lawsuits; one from ESPN for interference with a contractural relationship and one from the event producer for Copyright infringement.

So, sure, you can tape it. But the minute you show it you're toast.

So if the event does permit camera and filming then I am allowed to show it on the internet?

Did you not read BB's post? Filming the event or allowing cmaeras at the event is not the same as broadcasting the event -- which is what you want to do, essentially. You will need to talk with the organizers of the event (not the ticket guys, the actual organizers) to find out if ESPN or whoever has exclusive broadcast rights, or if you can put your film on the web.

And you might want to get it in writing if they say it is cool...
