On Feb 13, 06, I received a call from an employee working for an attorney, she stated her name & which law firm she worked for. Sounded quite serious & very formal. She then said are you ______? I said yes . she stated we are trying to locate the next of Kin to a ________ . ( States my Sons NAME) Then she asks , are you his Mother? I said yes. She then says " He's been killed in a car accident! I fell to my knees, screaming sobbing as I asked her if this was a joke? She stated no it wasn't. I said, then why did you not send a police officer with this information? My world crumbled..I lost my colored sight. Everything went black & white! I countinued to scream .I lost contact with her. If it weren't for my employees holding me back, I would have gotten in my car & started driving. Not sure now where I would have headed. She calls me back minutes later & tells me I need to calm down! She asks me my Sons Date of Birth & Middle Initial. Well apparently I have the wrong Family. This person is much older than your Son. I screamed, sobbed, yelled at her telling her how poorly she had handled this. Apparently she was trying to settle an estate. She said she was "NEW" at this! Do I have any recourse? I own a small business & would surely be sued if my employee caused this kind of mental anguish to a customer. I still have flashbacks to that terrible moment, have trouble sleeping & I feel very anxious & unsettled. I am not a nervous person or one who overreacts. I have considered going to get some drugs to help me thru this. What can I do Legally? Thanks in advance, DebbieWhat is the name of your state?

You don't have any recourse. This doesn't qualify for intentional infliction of emotional distress, for several reasons.
