I bought a bad pastry from the supermarket. It taste like straight rubbing alcohol. My boyfriend got really sick off it. There was no expiration date on the package and
Is made from a local pastry shop here in dallas Texas. Can I sue them?

So after taking one bite and it tasting like "rubbing alcohol" he continue eating it? If it tasted bad why didn't he just spit it out and return the pastry for a refund? How sick did he get? Did he go to the ER? If so...did he bring the pastry with him and did the hospital run any tests on the bad food? If so what were the results of that test?

Why should you be able to sue? It's your boyfriend who got sick, right?

How sick did your boyfriend get?

Did you taste the pastry to know that it tasted like rubbing alcohol or is that what your boyfriend told you?

Did your boyfriend have the pastry tested or did your boyfriend consume the entire pastry?

Most small pastry shops do not package their pastries with expiration dates. The pastries are made fresh daily. That said, I remember getting sick once from eating a cream cheese pastry at a small pastry shop. The cream cheese was apparently spoiled.

But I did not see a doctor, and I did not have the pastry tested, and I recovered just fine. There was no lawsuit to consider for me (no damages) and I doubt strongly there is a lawsuit for your boyfriend to consider.

Did he speak to management at the supermarket or to the owner of the pastry shop? Your boyfriend might get an apology and a free pastry if he does - and this could prevent others from getting sick.
