I have no idea what what I said was not in this post

Hello, I am apart of a union at my job, my union contract states that my employer cannot send a union employee home early unless they A. Want to go home early, or B. Through an act of god. It states, that if the employee is sent home they must be paid for the entire duration of their scheduled shift regardless. I had not seen the contract till recently finally obtaining that information. For months my general manager had been sending me home against my will. Do I have a case here?

That is something that you should be discussing with your union rep.

What is the name of your state? Never mind. I see from your other thread that you are in California.

Was there an act of god?

Were you paid for your entire shift?

What did your manager say when you approached him about the matter?

What did your union representative say when you approached him?

These posts have nothing to do with each other first off. I have every right to seek advice on any situation I have been wronged in.

And for your information. This issue was sorted out today and I got them to agree to pay me all the money they had owed me, without legal action.

So obviously I could have sued them or they wouldn't have cooperated so easily!

There was never an act of god any of the times. No they didn't pay me for the remainder of the shifts. I didn't talk to the manager I went straight to the district manager to get it handled immediately.

And it was. They agreed today to pay me what they owe me. Thanks for your input.

Actually you wouldnt have a right to sue them. When there is a union and a collective bargaining agreement your path to justice is by filing a grievance through your union. You have to avail yourself of the union process before anything else. Depending on the outcome and the facts in play, that may have been your only process available.
