What is the name of your state (only U.S. law)? kansas.
in short, I received a letter and several checks stating that my lender had been charging me interest above my states limit and that they owed me the refund.however I went into foreclosure and had to pay huge fees and more to bring myself out of it, 7000 total but if they would have been charging me correctly I could have avoided foreclosure all together. I haven't heard anything else from them and am still paying 9.75 percent on a 52,000 balance. furthermore I received a notice that they are being sued for their lender placed insurance practices which I had lender placed insurance separate issue but this lender has been nothing short of trouble to many

Kansas has several laws regarding interest rates. I can't see where 9.75% is anywhere close to usury but I don't have time to search through them all.

16-207 says 15% is the limit.

Are you sure you aren't misinterpreting what that letter is trying to tell you?

Perhaps you can quote it word for word here.
