can I sue the bank?

What is the name of your state?tx
Someone tried to get a loan from a bank by using my personal information. I was completely unware of it and don't know how that person got my personal information. I see a hard inquiry on my credit file. I am thinking to file a law suite against that bank for not taking precautions to identify the loan applicant correctly. Do I have legal recourse to do this? Where should I go from now?

**How did you find out? If they tried but failed why is the bank responsible? It wasn't your friend who wanted you to co-sign on the furniture deal, was it?

My response:

If the "applicant" had YOUR personal information, what did the bank do wrong?

My friend wanted to cosign me for a furniture loan and when I stopped him he did not apply. The inquiry on my file is for an auto loan. I received a credit alert from an online service that I subscribe to and thats how I came to know this inquiry.

When someone goes for applying a loan don't they have to check ID and properly identify the person applying for the loan? If you think bank is not liable for their neglect in properly identifying the person, who is responsible then? I know once I find who has done it then I can file charges against that person. But, isn't bank also responsible in part to this?

My response:

When someone goes? Who do you know, nowadays, that "goes" anywhere to obtain a loan?

You can get a loan approval right from your chair, in the comfort of your home or office. It's called the Internet.

All someone needs is your identifying information; e.g., your Social Security Number. No one needs to physically "see" you in order to obtain a loan. Your identification is all that a bank needs to "see", along with your other personal information.

It's your responsibility to keep your information safe from prying eyes. You may be a victim of "Identity Theft".


In the voice of a Kentucky woman, with a heavy "twang" accent:

"Once I got his credit card, I hit the ritziest home shoppin' channel on T.V.!

I got two Black Hills gold ankle bracelets, stirrup pants . . . Oh! And a set of those press-on nails with diamonds built right in!
