What is the name of your state? Indiana I have a couple of questions. Last year I filed my taxes on the net and they were rejected because I claimed my child on my taxes, as it was my year to do so. Well so did her mother. I then sent them in paper form to the IRS with a copy of our court papers showing that it was my year to claim her.
Over the weekend I received papers from the IRS. The papers stated the two people had claimed the same dependent and they were asking me if the social security number I had entered for my dependent was correct.
I called them and they told me that they sent out duplicate forms to her and I so that whoever made the mistake has the opportunity to correct the error. They asked me at the time if I had the right to claim the dependent and I said yes that I had sent a copy of my decree with my tax forms. They said they would gibe her a little time to correct her taxes and if she did not we both would be getting a letter.
Over the year we have been in battle over visitation, which I won. Then we went at it over child support.
In the child support situation I offered her three proposals in which she was to produce financial evidence in any of the three. I wanted her to produce her 2005 tax return to show what she actually made for the year and also because she had claimed our daughter.
Well my attorney drew up a subpoena duces tecum for the paperwork but against my wishes did not file it. When I questioned their office about why we did not receive the paperwork his paralegal said he was satisfied that they had accepted one of the offers and did not feel the need for the paperwork. I specifically requested her tax return.
Here’s my question. I received my bill from the law office and in it they have charged me for preparing the subpoena duces tecum.
Should I be charged for something that was never followed through with?
I also with the help of a friend drew up my proposals on my own because I got tired of waiting for my attorney to do something. The only thing my law firm did was copy it and placed it on their letterhead. None of the wording was changed. Yet I am being charged for them drawing up the paperwork.
Should I be charged for something I came up with?
Also now I may have to defend myself if I am audited over the IRS thing. I am not concerned about my tax return but now I may loose more work time over this. All the time I lost over the year was due to her and my attorney not handling things like he should have.
Its ironic I got my hair cut 4 times this year so far so I would look nice for court and as of yet I have still not been in the court room.
I feel that this law firm mishandled this whole case. If it were not for me contacting them I would never had been made aware of what was even going on.
Can I sue them for misrepresentation?
Can I sue her because she never produced the paperwork as agreed?
Originally she agreed when we settled over the visitation issue to provide me with all financial paperwork for the pending child support case and she still to this day has not produced it.
