Can my husband's x take daughter out of country??

Please note that I have also posted this in "immigration laws" but since this is "family related" I am also entering it here

Before I met/married my husband he had a daugher with another woman. Both of them are from El Salvador.C.A. Please note that his x girlfriend is an illegal alien. She now wants to take her daugher and go back to El Salvador. What are my chances of going to court and either stopping her from taking my husbands daugher away from us. (Please note: we live in MA and I am a US citizen) Should I start to go to court now? Should I contact INS? I really don't know where to start with this. Can I legally adopt my husband's daugher?

I'm not saying this woman is a "unfit parent" I'm saying that she is just going to take her child and leave the country? Can we do anything to stop this or can she just do this and my husband has no say in this??

You, can do nothing as you have no legal say in this matter. Since they are both from that country, chance are that she would be allowed to return, even if you did get her into court. Since she is an illegal alien, should the INS find her she will be deported, with child.

Sorry but what are you saying yes to? Can I or should I start going to court. There is no kind of order with the courts. Are you saying that she can take her daugher and leave the country. Please advise

NO... SHE can do nothing.. she is not the bio parent and has NO legal standing in this case AT ALL.

Can my husband go to court

We don't want to take her child away from her. We just want to know if we (or my husband) can stop her from taking their daugher out of the country. Again the daugher was born in the US

Of course.. a district judge ordering visitation is going to be worth nothing if the INS gets an order to deport her..
