Can Prostitute keep joint custody??

Was wondering if anyone knows anything about this particular situation I am currently in. Found out my x-wife is now a call-girl(we share joint custody since our divorce 3 years ago) and I'm obviously concerned about the kind of lifestyle she is involved in.

I have proof of this as she has a website and what concerns me as well and almost as much is the fact she has a boyfriend who quite frankly, is a "sleaze ball" as he has numerous arrests for assault and alcohol issues as well as he recently got a DWI. My X also has a DWI recently as well and I suspect she has alcohol issues as well.

I love my 3 boys very much and I've been there for them all their lives. I have a steady job, I have a nurturing and sweet girlfriend who adores my boys and the feeling is mutual. I guess I feel I can provide my boys with a much more stable and secure enviroment than my "Jerry Springer show" ex-wife and so I was wondering if:

A) My X being a call-girl with a DWI and a pyscho boyfriend would deem her unfit first off.

B) How good of a chance do I have of gaining full custody of my boys considering how from the research I've done, I haven't been able to read too much case law on this type of situation and so I'm a bit nervous as to the outcome.

I'd appreciate any thoughts you might have for me.

PS: I've already hired a lawyer to get things started but wanted to read some thoughts anyways from the folks here in this forum.

Hey! Remember that girl from about a month ago who said she was an escort seeking custody? She had a drunkard boyfriend and she had a DUI also. Coincidence? Anyone remember where she was from?

Is that so Miss Panties...that really is a coincidence. I did a search here in this custody forum when I discovered it yesterday when I got off from work and didn't find anything like the scenerio I'm currently in.

I tell ya, when one is in the unpleasent situation I'm in, trust me when I say this, you feel as if your the only one in the world who is going thru it. That being said, what kind of chances do you feel I've got in convincing a judge I am the better parent?

Question for any lawyers who are reading these posts:

What is the statute or law on proving a prostitute is unfit?. Is there any caselaw for one to read on this subject?. I've surfed and surfed the internet doing google searches with different criteria but I've yet to read anything that quite answers the questions I have in my situtaiton....thanks in advance

Tommy, the reason you didn't find any statute or law stipulating that a prostitute cannot have custody of a child is because none exist.

Custody is not decided on the occupation of the parent, although it plays a part if it puts the child in danger. What will decide custody is the 'best interest of the child'.

That simply means that IF the parent's chosen occupation contributes to a situation that puts the child in danger or in a situation that is unhealthy, the court can remove the child from that situation.

Ahhh I see...thanks Oberauerdorf for the insight and here it is I'm tearing my hair out wondering why I can't find anything. Well, I obviously don't think there is any question that my boys being with me is in their best interests. I mean if you look at the differences in lifestyles between myself and my X, its like night and day. I'm not saying I'm an angel or that I don't have some skelatons in my closet from my days back in college but for the most part, I live responsibly and afford my children with a safe and secure enviorment.

I can't say the same thing about my X as though I doubt very much, she does here business there, I do know from what my boys at times mention, that she and her boyfriend are always fighting, she is at times needing others to babysit them at night, they have missed time at school on the days she had them and its just an unhealthy environment for them to be in IMO.

Hopefully I can convince a judge of this seeing that from what I have read, judges ordinarilly don't like to take kids away from their Moms unless they are involved in illegal activities.

Dunno, maybe I'm missing something here, but a mom as a prostitute or "call girl" and the sleazy lifestyle she leads, sure seems to be not in the best interests of the children....ya think? And what makes it really crappy is that she is attempting to poison the boys minds with lies and false inuendos about me almost attempting to "brainwash" them into wanting to be with her. Seeing that my oldest is 12 and the other ones are 10 and 8, I believe only the 12 year old could testify if need be. I'm trying my best to not let them know why I'm attempting to gain custody other than to say that I believe its in their best interests and when they get older, I'll tell them. But in the meantime the mother is saying all these lies about me and my girlfriend, its getting increasingly frustrating and thus why I have to do what I've got to do here....it just sux that's all....really does as its so unhealthy for the kids to be around her and her sick boyfriend even 1/2 the time.
