I've posted before about problems my neighbor was having regarding her kids and ex husband. I've been to court for them. The husband is very violent and its documented. He want to county jail for awhile because of his actions towards them.

Today, her "step" daughter (ex's first child) ran to her house. Apparently her mother and father are back together and the father (my neighbors ex) is acting out and the girl got scared. My neighbor naturally wants to protect her. The girl is underage so I told her she could not keep her from her parents. So my neighbor then called her ex's house and spoke to the girls mother and she said yes she can stay at my neighbors. However, the ex husband says "no way". The ex cannot come near her or her children due to a restraining order.

Can she get into any trouble if she lets her "step" daughter stay the night when mom says yes and dad says no? It seems tricky because mom could easily change her story.

It is tricky and if dad says no she should send the child back home. If the child is being abused she could call CPS and have them come out and take a report. Of course that is IF there is PROOF of the abuse. If it is a DV issue between dad and mom and it is ongoing then the child or someone who knows of the incident at the time should call the police and they can do a juvenile rule 6 removal.

Thanks. I don't believe (from what I know) that the child was being abused. I think another physical fight broke out between mom and dad from what she said, and she wanted out.

Dad has only visitation of this child. Not even joint legal. does that change your opinion on her staying at my neighbors with the OK of her mother? I should have stated that in my original post.
