I live in California, my son's father in Texas. We terminated his rights 4 years ago because of our bad relationship. Now he wants the decree set aside. Will he be able to do this?

My response:

I presume the reason why you mentioned that you live in California is because that's where the child resided at the time of the termination. If that's not the case, then pay no attention to the following :

Unless there was fraud or duress from the beginning, and either one of those grounds can be proven, then the answer is no - - the parent/child termination is permanent.

I lived in WI at the time. He's now saying that he only agreed to the termination because I told him he would be able to contact and visit my son when ever he wanted. This was not the case although I told my lawyer that when my son was older I would let him call, but that was to be my choice and only when I thought my son was ready. Will this make a difference, I really don't want to have any contact with him and my son shows no interest in this man at this time. (He's 10 now, 5 back then)

You lived in Wisconsin at the time of the termination ?

And, for some reason, you didn't feel that was important to mention ?

Since you have your own attorney, deal with this through your attorney.
