Can the other party legally do this?

What is the name of your state (only U.S. law)? CA

I wasnt sure to post here or under the grandparents forum. My mother and my current father in law and his new wife have filed for visitation of both of my children. One child is from a divorce the other is not. We just got 2 dismissals on the case involving my youngest who is from a married home.

We have gone to mediation for my oldest who is from a divorce and have a 2nd mediation mid July with a hearing end of July.

I have found out since Mondays 2 hearings/dismissals that at least 5 ppl so far have received a packet of papers from my mother. These were made out and dated PRIOR to our original mediation and mailed out PRIOR to the hearing on Monday for the other childs case(s).

The papers are my entire packet I submitted to the mediator/parties from our original mediation.

Can you legally just copy mediation documents and mail them out to whomever you feel like and highlight about 90% of it and say that person is a liar, a bitch, etc?

Im going to call my atty this morning as well. I consider this slander and harassment! I would LOVE to mail out her letters to the courts to everyone to show what a wack job she is but LEGALLY I ASSUMED you cant do that crap!

Plus is there anyway to ask for a hearing NOW and stop all ongoing mediation, etc? She clearly hasnt got my childs interest in mind and Im wondering if there is anyways to get all these letters she mailed out to ppl with my court docs before a Judge and not just the mediator?

In case you havent read thru the lines, Im dealing with someone who is mentally "off". So far though, the courts dont seem to care and think I still need to fight for my childs best interests.

Also, I should note her attached letter to everyone says "goodbye, F all of you, etc"

Im still waiting to hear from my attorney on this matter.

I have called the mediators office as well but have been on hold each time for nearly an hour before I keep having to hang up.

I just want to know, can you legally copy and send out mediation records to anyone you just feel like when the case is still ongoing?

Yes, 3 of them would be called as witnesses if this ever went to trial. They can back me up on information concerning my Mother of why I have concern for the well being of my child in her care.

So, they were not parties to the case that she sent the packets too? They were potential witnesses or family/friends?

Talk to your attorney however I suspect that the judge is NOT going to be at all pleased with grandma, and it may actually add credibility to your reasons for wanting to keep the child away from her. Grandma may have actually done you a favor by doing that.

Thank you for responding. Im trying to be patient and wait for my atty, but this is BEYOND frustrating. Im hoping we can even skip the second mediation now because she has done this. ;)

Will these witnesses testify that it was GRANDMA who sent them the paperwork? Might want to consider a handwriting analysis in this if you can't get grandma to testify that she did it.

They are willing to testify as well.

I have one family member who is mailing me her packet, along with the envelope as well showing where it was mailed from.
