What is the name of your state? NM

My daughter was visting an x boyfreind who is on house arrest. His detention center officer (who is not a certified law inforcement officer) came to check on her x. She was handcuffed for officer safty as was the x. The officer proced to as where "it" was. They replied what are you talking about. My daughter stated that she wanted her Lawer. He pulled out his pepper spray and held it to her face and state where is it or I am going to spray you.

Yes, they can do that.

She has her very own lawyer...how proud you must be......:rolleyes:

Unless the ex boyfriend was forbidden visitors as terms of his release, (which in and by itself could be against public policy,) the detention officer abused his his authority. Restraining her with handcuffs may be classified as kidnapping. I don't have all of the facts, but on the basis of what you wrote, she may have an excellent lawsuit. The D O should be fired.

Start with getting a lawyer who will file a criminal complaint. with the local police

Unless you have walked in my shoes, don't presume to know me. After being recruited by the feds in 1956 while still in service,I graduated law school in 1960. I then spent the next 21 years as a federal agent. I am 71 and admittedly rusty. I was never in private practice and I haven't cracked a lawbook since 1981. But the basic concepts of law haven't changed too much. I stand by what I wrote.
