What is the name of your state? PA

We are closing on our new home on 10/25. We were informed the sellers would be out on or before 11/5. No problem. Movers hired for day after, and will have utilities switched on 11/5. Got a call from our realtor this morning ,apparently their agent screwed up and she now says they can't/won't be out until the eighth. They will be paying us rent from the date of closing until they vacate, so it's not a money issue. The issue is this, our movers have been scheduled, landlord informed and he's planning on moving in here as soon as we're out, my husband has already scheduled time off to move, etc...

My question is this, do we have to allow them to stay any longer than we were originally told, seeing as we will own the house by then? How big of a problem could this be in respect to closing? Can we tell them when they have to be out?

No, you don't HAVE to.... but the legal process of actually getting them out will take much longer then the few days that they are staying.

Since you already have a 'rent-back' agreement, this additional days shouldn't provide any real problem. See below.

Of course you can tell them that. However, doing so BEFORE you close could put the entire transaction in jeopardy. Are you willing to risk that??

My suggestion.... figure up what your ACTUAL damages might be as to their delaying the move... then ask them to reimburse you for them in addition to the few extra days rent. Get their agreement in WRITING. Finally, if they are simply unreasonable and refuse to 'work with you'.... and 'you with them', then you may have to either accept their situation or decide it is unacceptable and walk away from the deal. Of course, walking away will likely create a HUGE legal problem that could again cost you far more than this is worth.

Only you can determine how important this 'issue' is to you.
