Can they take her daddy??

Iam married to a man from Peru. We have filled out all the paper work and even hired a lawyer. We have been married for 3 years and we have a 3year old daughter. What i would like to know is can they send my hubsand and our child father back even though he suports his family or can they just send him back. Please any info will be greatly apprecated.
