I'm almost sure she's using drugs or at least pot, she actually told me in the past that she used it and I know that won't help unless I had that confession on tape, but if we suspect it can we court order one. Does she have to have notice ahead of time that she's gonna be tested? Would we have to pay for that, since we wanted to know?

You can suggest anything, whether you get it or not is two different things. I say, you request it you pay for it.

Be prepared, however to take one yourself. My X has a little girl with another woman and she requested one on both of us and we turned it right back on her and her husband. How quickly she changed her mind.

You got good answers from the others but I will also tell you that very frequently judges WILL NOT order drug tests unless there is some outside evidence of illegal drug usage.

Judges hear so many false accusations in court from one parent against the other, that they often won't give them crecedence without some outside evidence or documentation.
