My son is in trouble and his lawyer told him last time that the judge made his desicion and sending him to jail coming month ,so dont waste your time and money going back to rehab...Now we found out that he shouldnt leave the rehab and his pro officer saying that with him did not go back to rehab the judge may send him to prison instead of jail.Pro officer told me go to court and tell the judge what the lawyer told you and dropp the lawyer.I am afraid to do that..Lawyer is waiting for me to pay his money. He told me if I dont he wont show up.which I should do?..not pay him and go to court and tell the judge or tell this to this other lawyer who we originally hierd and tell him his associate made a bad suggestion and ask him to come to court and fix it?what should I do?I dont think he would come to court and tell the judge what his associate did.How else he can save my son from this?

He is facing what he deserves, lets say...My issue is his pro. officer's report...we been told by his lawyer last time he was in court that do not waste your time and money going back to rehab for your last days since the judge already made his decision...you are going to jail for 6 months...we were under impression that the judge took him off the rehab program and we came home and waited for his surrender day...few days ago I got a call from his pro officer saying he missed the rehab for 3 weeks judge would send him to prison istead of jail when he sees my report...been advice to dropp the lawyer go to court without the lawyer and tell him what the lawyer told you and the judge may still keep him in jail...My question is should I do that or still talk to the head of firm tell him what the lawyer did to us and ask him send someone else to clean the mess...my second question is How a lawyer could fix this mess? he wont tell the judge its their fault!

In answer to Mommy...addiction is a sickness...They need help and support...I agree he broke the law..He is a kid and when he hooked he was only 16...He is not a criminal for God sake!

Then he should have stayed in rehab no matter what effect it would have on his sentencing.

Yes, by definition, he is a criminal.

Luckily for him, he is young and still alive. He has time to turn his life around.

What???? I can't understand a thing you just said.

Your son has a choice. Your son can tell the judge why he skipped out on the ordered rehab and beg for leniency.

You (if your son is still a minor...you say he was 16 when he started) can talk to the other atty. You can file a complaint with the bar association.

However, until there is an actual sentence handed down, there's really not much that can be done right now.

The PRO isn't the judge. He doesn't KNOW for a fact how a judge will rule.

So, You saying go to court without a lawyer?...That I am afraid of...I still think maybe the same law firm would know better how to keep him in jail instead of prison by using different strategy...Been in courts so many times...working with lawyers also(civil era)...They can do alot!...But again Dont know what to do.

I didn't tell you to have him go to court without an atty. I told you to tell your son to be honest when asked why he skipped the rehab.

Picture this...my son standing next to his attorney and attorney is talking for him... and if the judge ask my son why you didnt go back to rehab...You think the lawyer would not defend himself by saying.."That is not true"... and who do you think the judge would believe?..By the way if I am not already clear with what I need to know for you nice people I should say that English is my third language ...so bare with me!
