What is the name of your state? Louisiana

My husband and I moved to La from Fl in May 04, I am unable to find a job to cover all my bills, husband is starting a business and has yet to make any money. Most of the credit cards are in my name. The car is in my name. Can I file bk7 and not affect my husband? Will my car debt be completely gone once I return it? Should I wait to file until a creditor files suit? In Louisiana, can they garnish my wages or get money from my bank checking acct if we have a joint acct.

Yes, they can garnish wages in LA
Yes, they can sieze your bank account - AFTER they sue you and win a judgement against you.

YES, you can file BK w/o your husband, just keep in mind that LA is a community property state.

Also keep in mind that you must be a resident of LA for at LEAST 91 days before you can file for BK there.
