my husband bought our granddaughter a car leaving it in his name carrying her on our Allstate insurance with liability on the car. her boyfriend which they lived together said he would pay his part of the insurance preiunm if my husband would put him on the policy! which my husband did. the boyfriend would not make the payments so my husband took him off the policy. Our daughter & him were coming home from out of town with him driving the car when he had a bad accident. they said it was his fault. Our insurance said he was an excluded driver & they would not pay off the other cars damage which they say was $7,853.78. This all happened in 2003 & we never heard anything out of them until last week when a subrogation thing sent us a letter saying we are liaible. We did not give permission for him to drive the car & did not know of the excluded driver thing either. we are seniors on a fixed income & the reason we pay insurance is to not have problems! where do we stand? They said my husband will lose his drivers license.

You will need to be found liable for the damages by a court. Were you found liable by a court, or is it just the subrogation company saying this?

Your husband is liable for these damages. He will then need to sue your daughter's boyfriend.

They said my husband will lose his drivers license.

That will be determined by a judge.

You husband put himself in this situation by keeping the car in his name, and by not doing anything when he knew that your granddaughter's boyfriend would probably drive the car without being insured.

the boyfriend is in jail and probably will be for some months. no we have not been to court. after the wreck in Sept. 2003 their insurance co. did not do anything. now it is the subrogation company saying this and they are making threats if we don't pay within 10 days.

The subrogation company is just trying to scare you. Until a judgement is granted by a court, there's nothing they can do.

Thank you for your replies Teflon Jones. the subrogation co. has done a good job on scaring us as we are seniors barely making it & we pay a big portion to insurance every month. Like everyone we think this protects us. this mess could ruin us. the boyfriend could care less taking it easy in jail.

Unfortunately, if you are sued by the insurance company that paid the claim, they will most likely win the case. Be careful who you buy cars for and how they use them!
