car dealer left my hood unlatched,crash highway

What is the name of your state?ny

the dealer left my hood unlocked.
on the highway go boom and destroy car.
dealer say,we close hood.
maybe owner will do something,we will let you know.

what do i do?what are my rights?is this negligence?

How can you prove they left it unlatched? How can you prove that you didn't open it and leave it unlatched? Do you have insurace? They may be nice, but chances are you are gonna carry the burden of proof.

the salesman admitted to the manager that he unlatched it inspected and closed it.
the hood poped open less than a mile away from the dealership.

im going to record a phone conversation,what would be best to get on it?

first you need to know if that's legal in your state or not. Even if he admitted opening it and closing it, he states closing. He could say it was a faulty latch and then it might still fall back to you. You still didn't answer the question on if you are insured? They will go after them if they think its reasonable.

What year is this vehicle and model? Check to see if theres a recall on it. Chances are your stuck but theres a safety device called a second latch and you need to prove it was defective ..............if the dealer claims that they inspect the vehicles and that they are road worthy or warranted for say 30 days or 3000 miles talk to the general manager or the owner of the dealership. If this is a used car only dealership try but good luck...........used car dealerships if theyre big can respond to consumers too.

its huge new dealer.nissan,,my CAR IS A MUSTANG GT 40k miles 1995 it was in immaculate condition..i have in surance,but just basic liability.so my ins comp dont give a flying bats hair.'
they invited me to sit down with the salesman,manager,owner just today.
im awaiting a call.
are they baiting me?theyre gonna have lawyers and a team of people?

Who knows if they are baiting you? Couldn't channel Johnny Carson to see if I could talk to Carnac the Magnificent...

Good luck...doesn't sound like anyone got hurt, thats good.
