I am from KS and I received a ticket for expired tags and no insurance. The officer towed my car. Three days later I went on maternity leave and did not receive a paycheck for 6 weeks. I was unable to get the car out as a reult of my financial situation. I turned the car back over to the credit company and they called to tell me that the car had been sold. I was never notified. I called the tow company and they told me that they had sent a certified letter both to the credit company and to myself. It was sent to an old address and I never received it. The car was towed July 13. They said they sent the letter Aug 21. I called Sept 22 and told them that I was returning the car to the credit company. They put the car up for auction Oct 4. I asked about my property inside the vehicle and they told me that it had been destroyed. Do I have grounds to take action against them? Do I have to name the credit company on the suit as well?
Any information you can provide will be helpful.
Thank you.
