Car problem with private seller

We purchase a car from a private seller and paid the seller a portion of the asking price. The seller was very eager to get the car out of his home and drove the car to our house. While he drove it up the driveway, it leaked oil all over the driveway and now the car wont run. We called him the next day regarding the car and he didn't return our phone call. During the weekend we tried calling and he hung up on us. Several times. We have left numerous messages and he wont return a phone call. He has the title to the car and our portion of the payment. We do not want the car. I am not sure what to do. We both the seller and I have copies of handwriting receipts for the portion of the payment we have made. But as I said before he will not return our phone calls. So even if we wanted to give him the rest of the money, WHICH we DO NOT. We cannot get a hold of him and He, The seller, has the title to the car. I am not sure what to do with this car that is not running in my driveway. Should I take him to small claims court or can I have the junkyard come and get this car and not be responsible for it? I just want this over and done! I am not really concerned with the money that he has. I just will chalk it up to a lesson learned. Any advice would be surly appreciated!!

If you are not concerned with the money then the next time you may not get the chance to recover.

The minimum you should do is to write him a Certified RRR letter informing him that if he does not remove his car in 15 days from the date of your letter, you will have it towed away.

Since he is the legal owner of the car, it will be up to him to pay the storage fees. :D

Now, what EXACTLY does your receipt say. and WORD FOR WORD, do not paraphrase.
