Yes, but if you read the thread, you would know that the vehicle owner is parking in the HOA common elements and the HOA has stated that they did NOT authorize that tow company to tow. That's why O.C.G.A. Section 44-1-13 applies.

Yes, but if you read the thread, you would know its unreasonable for the owner's vehicle when stored/parked in the HOA common elements area to have a STATE tag.

If he's storing a vehicle for a year there's no reason to pay the road taxes for that year. There's reasons not to get tags.

Junk yards own cars that maybe be street legal and running but there aren't going to keep the tags up to date.

I suspect that the towing company has a contract with the HOA (as is usually the case) and as such doesn't require specific HOA authorization each time the company tows a vehicle.

Not everything needs to be solved in court, does it? how about a private property no tresspassing sign posted on the car. Or tow at your own Risk sign.

or Reach an Agreement with your adversary, so going to court will not be necessary in the first place, U think?

Thanks for agreeing with me that they should tell the towing company, which is threatening to tow, that they should agree not to tow because it would be legally wrong.

Of course, its good for the poster to know the law (O.C.G.A. Section 44-1-13 ), so they can prove to the towing company that the tow would be illegal.

True, but it doesn't matter. Even if the owner was required to have a state tag on private property, the tow company still needs HOA authorization to tow from HOA property. The poster has told us that the HOA has not given permission.
