I was in the fast lane of the North 405 freeway in Torrance, California, the car in front of me broke down. The cars to the right of me would not let me over even though I had my right signal on. I used the carpool lane to pass the disabled vehicle and was pulled over less then a half mile later, while I was signaling right and exiting the carpool lane. I told the officer what had happened, but he could not see this vehicle because it was right around a bend in the road. Do you think a judge will dismiss this, or is it your opinion I should just plead guilty.
I appreciate your advice,
Thanks,

My response:
What I don't understand is why you stayed in the San Diego Freeway carpool lane for 1/2 mile? You could have recovered your lane in less than 1/16 of a mile. I am very familiar with that freeway, regularly using it to go to and from the Torrance courthouse, back to my offices in Encino.
Do NOT plead guilty. Read my "Knuckheads" post, and use the form. Make the prosecutor and judge do their work, save yourself the points, and THE EXTREME FINE for this infraction. Did you know that the fine will be "enhanced" by a factor of 171% ? For example: A $75.00 fine turn into a total fine of $224.44 !! That's not to mention the points on your license, plus the higher insurance rates.
Now, there's one other possible solution. Pay the fine, and ask the judge to order your matter into Driving School. You'll spend 8 hours "re-learning" your driving skills, but you won't have the ticket on your record - - this, of course, assumes you haven't had a ticket in the past 6 months. If you have been to Traffic School in the past 6 months, forget it.
Good luck, and let us know what you've decided.
