As I can see, trying to be more right than the next is NOT a legal question. The thread, "We can give a kidney-Just not gay blood" was LOCKED. Be nicer, and it wont be. ;-) So, this continues....

Dearest "Beleeze"..lol, or whatever that is...those links to trials you posted earlier were certainly legitimate, I'll give you that. HOWEVER, after doing research, and much needed I might add, they also had ONE common factor:
None of them included anything anywhere about gay men being denied blood.
Your point was?

My point is, GAY men are denied the ability to give blood. As a gay man, and as a lot of others will see it, it is not a "rational" act of denial, nor needed, and therefore UNCONSTITUTIONAL. Simply put. Many others have already agreed with me on here, other "legal experts" alike as you might call yourself, given the fact no one seems to be as able to answer a legal question as good as you...or so YOU think anyways...LoL!

Lawsuits have been attempted, overseas as well. This is not a "new" issue. However, it is NEW to rally up thousands of people and grab a couple good attorneys and rally up to Washington and the highest courts to illiminate this stupid ban born out of IGNORANCE. My legal question was:

*Can someone sue (class action) for discriminating against disease free gay men for denying them the oppurtunity to donate blood?*

I believe this is a VERY good legal topic, a great thread to post to, and an issue that needs to be faced heads on. I have been an activist for years in the gay community, and facing these issues, along with GLAAD and ACLU, is not something that is out of the impossible. You just have to rally up a lot of lazy people in Washington to LISTEN. I admit, maybe I am not the MOST intellectually legal advocate on this site, but I believe that the post I just wrote deserves attention, whether negative or positive, because any and all information given would be beneficial towards getting an answer. Thanks!!

What you're describing would be FORCING an institution to accept a donation. It doesn't matter if it's blood, old clothing (Good Will), old cars (Esperanza Unida), or whatever.

It doesn't matter if you think their policies are discriminatory or not. You can't force a group to accept a donation.

Just for the sake of argument, let's say you sued, and by some bizarre planetary alignment... you won.

What's to stop the blood bank from tossing your pint of blood in a biohazard bag, or pouring it down a drain for that matter? What have you really accomplished?

I agree that this is now a dead issue. My question to you in your original thread on this topic was, "Have you contacted GLAAD?"

Well, have you? GLAAD is the one organization that might be able to help you, that might have others who are as angry about it as you are, who might have the means and organizational powers to do something about this. If they are not willing to go to bat over this, what chances do you think you have?

Remember, that this forum can only offer you advice based on past experience or, in Breezy's case, actual case law. You can't win or lose your case here. Either contact GLAAD or go hire a lawyer.

Ok, FINE. Yes, I contacted GLAAD, and ACLU. I am also contacting John Cornyn, Kay Bailey Hutchison, and Troy Fraser, by certified mail of my intent. Thanks for your reply....it helped BIG TIME!
