What is the name of your state? Currently reside in Nevada. My divorce was granted in New York and my ex-wife still resides in New York.

My situation: I was married in 1964, granted a legal separation in 1978 and subsequently divorced in 1986.

I am currently residing in Nevada, and am unemployed. I'm living on severence pay due to being released from my previous job because of job discontinuance.

I plan on collecting my pension when my severence runs out in 2003.

In a stipulation made during the divorce my ex-wife agreed to the following:

"In lieu of plaintiff's maintenance payments, defendant waives any past, present or future rights to equitable distribution of plaintiff's pension."

Based on this stipulation, can I cease making alimony payments once I start collecting my pension funds?

No it meeans she will keep getting her payments each month...in exchange for not getting 1/2 of either a lump sum distribution or your monthly check, from your pension.

hopefully she will die soon and that will end the payments...
