I am not a Florida attorney and I know nothing about Florida law.

But I read that FL courts are requiring that the lender produce the promissory note the borrower signed before they allow foreclosure.

If the creditor has the note, then they file the certificate.

I found this on the internet with about .475 seconds of searching on Google.

I don't have a clue if it's accurate.

Can I ask this,the lender is not the same lender that I got my loan in the first place.Wels Fargo who owns my loan now don't want to work with me at all.I been in foreclosure since Nov.2008,lately in the last 6 months now they are sending me a monthly statement like I'm making payments.I do thing they don't have the NOTE.I read somewhere that they where buying loans form other small banks and lenders and was not getting all the right paperwork which makes me think they don't have the note.How would I go about this?How can I prove that they don't have the note?
