Hi. I have a problem with other employees at work over my qualification to use California CFRA to care for a loved one that has obviously extended over to my employer. I am very naive to this whole thing; I have never had to use CFRA for anything before. Does CFRA protect my employer from denying me certain things like job promotion opportunities or benefits such as applying for an earlier shift? Or, does it simply protect my own benefits and my job?
I gave up a promotion to a better paying department within our company a while out of respect for the manager in that department. I thanked her for the opportunity as I had been accepted to join the team, but I was concerned that having to be out frequently at the time to deal with my family CFRA issue (this was end stage renal failure and diabetes related) that I would strain the department by not being there frequently. After the transplants came and went and things settled down I re-applied but was then denied for excessive absences. Employees started making comments that I was misusing the CFRA benefits and just using them for time off of my own. I had also requested early hours a long time ago and had to go on a waiting list as those shifts were hard to come by. After more than a year they started opening up - by this time I was using CFRA. I was passed up for these shifts, even though they would have actually allowed me to put in more hours at work. When I asked another fellow employee if they thought this was the reason, they said that I was unreliable and didn't deserve them anyway.
It's been 8 months since the transplants and things have settled down. My job also asks me frequently now to work early shifts on short notice as people have left and new people don't stay due to the stress of our job (I work at a national credit bureau). But if anyone comes along and requests an early shift, they come up to me and say they are giving it to someone else because they want to work early that day and take it away from me. They used to tell people to submit a shift trade request but have forgone this in my cases now.
I'm sorry if this rambles, but I'm not sure what info is important here or if the answer is simply that these things are not protected. Most of these people are in their 20's and I'm sure have not had to deal with something like end stage renal failure and severe diabetes, seizures, dialysis, CPR and all that comes with it. It was almost as rough on me and I managed to pull everyone through and keep working. Can they fire me for this since an employer can fire you for any reason - and just never admit to why? Is this something I could complain to the CA Dept of Labor to, in order to keep me from getting fired?
Any help is appreciated, as I said before, I am clueless!!
