My husband has a support modification hearing on October 12th. (He filed for this because the kids are no longer in daycare) He has not had a support modification since it was set in 2003. Up until January 2005 there was not much difference in his income. Then in January 2005 he jumped $20,000 when he took on a new job. However, due to a political shuffle, he was laid off after only 6 months. He then matched his salary three weeks later...but just lost that job again. (Up until this year he had a perfect job record) My question is...how will they evaluate his income? Will it be based on his 2004 tax return or will they extrapolate an annual income out of his last paystub.
Please keep in mind...my husband wants to do what's best for his kids. As I've said many times...they are in Missouri living with mom and a VERY rich step dad. We want to get the maximum reduction we can so he can put the money towards the huge expense of visiting them.
