changing filing status

What is the name of your state (only U.S. law)? Ohio
Over this 4th of july weekend, we always have to work a ton of overtime, can I change my filing status to exempt for this one check, then change it back to my regular filing status?
I know it will reduce the amount of my return at the end of the yr, but I always receive a fairly large return.

It is not legal to claim withholding allowances or complete exemption on a W-4 that you are not entitled to. Furthermore, your employer is not necessarily obligated to immediately change this for you. Payroll has up to 30 days and will often use this to discourage exactly what you are doing. Some payroll departments will flat out reject a W-4 that they know to be incorrect, or require the employee to prove they are truly exempt.

Under penalties of perjury, I declare that I have examined this certificate and to the best of my knowledge and belief, it is true, correct, and complete.

Having said that, if you are still overwithheld for the year then I doubt there would be any real consequences for you.
 
My payroll department already said if I have the change in by a certain date that it will be effective for this next check. I normally receive between $6000-8000 back on my return, so its not gonna be anywhere close to making it equal out, or make me have to pay. I know alot of people in the company I work for do this, and nothing is ever done.

I know it can be done, im asking cause I don't know if I can do it legally. Lots of things can be done, doesn't mean its legal.

And, just that easily, you can contact an attorney and pose your question to him/her.

Oh, and learn to spell... unless that is too elitist for you.

If you are not exempt, then yes, of course it's illegal to claim that you are. This is stated right on the W-4 form.

That's why this sight is called "free advice." There is no need to contact an attorney if I have other means of gathering the information.
As for telling me to learn to spell, grow up.

You asked a question and received several correct answers. Why are you still coming back?

And please note that spelling correctly is a sign of intelligence. Your very hostile refusal to do so indicates more mental problems than mere lack of intelligence.

Finally, you are using the term "return" incorrectly. The money the IRS sends to you if you've overpaid your taxes is called a "refund" - a "return" is the document you send to the IRS to notify them of said overpayment.

And why on earth are you allowing the federal government to keep your money INTEREST FREE anyway? :rolleyes: You'd do better to fix your withholdings so the Fed isn't getting any extra money and put the extra money in a savings account at .75%. :cool:
