In Texas when my son was born, his bio father was not there and did not sign the birth certificate, therefore the boy has my maiden name. The bio father has only been in contact with the boy a couple of times and has only paid less that $200 in child support in 7 years. I started dating my husband two weeks before my son was born and have been married for 5 years now. How would i go about changing my sons name to my married name since there is no evidence of the bio father being the father. Could i just go to the beareau of vital statictis and list my husband as the father on his birth certificate? Would i have to get the bio father to give up all rights? Please help!

There is a website (unfortunately I don't have the address) but if you search for stepparent adoption information you may find your answer. There are even ways for you to process adoption paperwork through paralegals (in the state of Texas anyway) and it is less expensive than going through an attorney. You do the legwork yourself filing the papers, etc. Check into it. If the biological father is not named on the birth certificate, you may not have any problems at all. Good luck.
