Quick question..

Back in 97 I defualted on a credit card resulting in a charge-off. The account was open in Florida.

A) Is the time length the delinquency can remain on the report and from what date would this be (date of last activity, etc)

B) After this debt does reach its age limit and I can legally force the credit bureaus to remove it to be in coordinance with the FCRA.. once its removed, if the debt still exists, can it be relisted?

If it can be relisted by the creditor because it still exists.. what options do I have between now and where it reaches 7 years old and I can demand it be deleted? Repay the debt? Ignore the debt and request the account be removed after its aged?

From what I've seen on my credit report the last time the account was actually "reported" to the bureau, or the last update that took place, seems to be in April of 2000. No updates have taken place since which may be because they gave up on reporting it or maybe it reached an account age/state where reporting was no longer necessary (saving them money). Originally opened in January of 97 I believe it was charged off in December of 97, I'm not real sure.

A1) A credit report can stay on your account for 7 years, 10 for a bankruptcy.

A2) Yes. But if it is, you need to contact them and ask that they investigate the report for expiration. If in fact it has expired, they are required to remove it (FCRA).

A3) If you are asking if you can 'demand' that a valid report be deleted, you can't. Obviously you can pay the claimed debt and ask that the account be noted as such.
